§ 3-5. Placement of sign warning of the dangers of alcoholic beverage consumption.

  • (a)

    Definitions. For the purpose of this section, the following terms should be defined and applied as follows:

    (1)

    Alcoholic beverage means and includes alcohol, spirits, liquor, wine and beer.

    (2)

    Vendor means any person who owns or operates a business establishment such as a bar or restaurant, which sells at retail any alcoholic beverage for on-premises consumption; and any person who owns or operates a liquor store, or other business establishment which has retail sale of alcoholic beverages.

    (b)

    Warning of dangers of consuming alcoholic beverages. All vendors of alcoholic beverages shall have posted in a conspicuous place in their premises, a sign which is clearly visible and legible to all patrons entering the premises which shall read substantially as follows:

    HEALTH WARNING

    ALCOHOL IN BEER, WINE AND LIQUOR CAN CAUSE INTOXICATION, ADDICTION AND BIRTH DEFECTS.

    REDUCE YOUR RISKS:

    DO NOT DRINK ALCOHOLIC BEVERAGES BEFORE DRIVING OR OPERATING MACHINERY.

    DO NOT MIX ALCOHOL WITH OTHER DRUGS (IT COULD BE FATAL).

    DO NOT DRINK ALCOHOLIC BEVERAGES DURING PREGNANCY.

    (c)

    Violation. A violation of this section shall be a misdemeanor, punishable to the full extent of section 1-6 of the Sumter County Code.

    (d)

    Applicability. This section shall be applicable to all vendors of alcoholic beverages in Sumter County. Notwithstanding this provision, incorporated municipalities within Sumter County may by resolution or ordinance exempt vendors of alcohol beverages within their municipal limits from the provisions of this section.
