§ 13-160. Change from nonconforming situation to another nonconforming situation.

  • (a)

    Approval. A vested nonconforming use may be replaced with a different nonconforming use subject to the following:

    (1)

    The proposed use must be allowed by this code.

    (2)

    The proposed use must be determined to be less intense or more compatible with adjacent and nearby uses.

    (3)

    Any additional development associated with the new use must meet all requirements of this and other applicable codes.

    (b)

    Limitation. Once a new nonconforming use is established, the property may not revert back to its original nonconforming use.
