§ 20-41. Expansion or modification of existing uses.

  • Road impact fees shall be assessed for the expansion, enlargement or increased use of existing developments based upon the applicable criteria of Appendix B [attached to Ord. No. 2009-14], as follows:

    (1)

    For uses where fees are assessed based upon square footage, road impact fees shall be assessed upon the net increase in the floor area of the development.

    (2)

    Residential uses shall be assessed for net increases in the number of residential units, even if there is no corresponding increase in floor area. Expansions of residential structures which do not result in an increased number of units shall not be assessed additional road impact fees.

    (3)

    Uses which are assessed based upon the number of specific features or capacities, such as rooms, births, beds, bays, servicing positions or students accommodated, shall pay the appropriate road impact fee based upon net increases in the number of those features or capacities.

    (4)

    Use changes in existing developments which do not involve the expansion or capacity modification of the development shall not be assessed additional road impact fees. Use changes involving expansions or modifications shall only be assessed additional road impact fees for the areas or features added, modified or expanded.

    (5)

    The road impact fee imposed for any accessory building or structure shall be that applicable to the principle structure.
